Agency51 acts as the data controller in many situations, for example when it comes to storing information about our clients and their store users.
As data controller, we are responsible for deciding what information is collected within our applications, how it is used and for what purposes. As a data controller, we have certain legal responsibilities about how we collect, use and share your personal information.

The information we collect, and how we use it.
Any data that Agency51 collect about you or your customers is treated with great significance and of the upmost importance. Agency51 will never sell or trade any of your data with any third parties, and will only ever be used for either communication between us or as a functional requirement as part of the software/application solution.
Your data
We only hold contact information about you, that is provided as part of the application install, in order to service our business agreement. this may include the stores user name and email address. This data will be stored in our CRM system and only be accessible by the relevant team members as part of standard business communication.
Visitor data
No personal customer data is stored, however we may collect data about a visitors browsing usage within the store, as part of the application in order to provide reporting as a software feature.
Cookies
Our applications use cookies. A cookie is a small file comprising of letters and numbers, which is sent to your device when you visit the Website. The cookies we collect allow us to distinguish different store users and are a requirement for the application to operate correctly. This may include, for example, cookies to remember when a visitor last visited the store and to gather usage data which is in turn used to drive the application.

Right to Be Forgotten
Under the General Data Protection Regulation, we as the data controller are obligated to erase your personal data as the data subject if one of the following criteria has been met:
- The data is no longer necessary in relation to the purposes for which it was processed
- If the legal ground for processing your data is based on consent and you withdraw the consent and no other legal ground for processing exists
- You object to the processing and Agency51 processes the data for direct marketing purposes or the basis for the processing is balancing of interests and Agency51 does not have compelling reasons for the processing which supersedes the data subject’s objection
- The processing is unlawful
- The erasure is statutory
